New health and safety legislation in April, 2006

Businesses will need to keep an eye on forthcoming changes in health and safety legislation which will come into effect in April 2006 and October 2006.

The HSE has published details of legislation due to commence or change in April 2006. Changes include

  • The safety case regime with respect to offshore installations
  • The implementation of the Physical Agents (Noise) Directive 2003/10/EC which lowers exposure action values
  • Environmental impact assessments for the decommissioning of nuclear reactors
  • Update to health and safety fees which the HSE charges for safety case assessment, inspections and approvals in the “permissioning regimes”, and other work regarding statutory functions
  • Regulation 22 of the Management of Health and Safety at Work Regulations 1999, to exclude the right of third parties to seek damages from employees in breach of their duties under these regulations
  • Replacement of existing regulations covering the safe transportation of petrol by road and rail.
